in effect, an Agreement on all matters then outstanding between the War Department and the Colonial Government but this Agreement does not define "Reserves" or "Clearance Areas" so any definition would have to be agreed to by both parties.

I would suggest the following:- Military Reserve:: an area held by War Department for Military purposes at a anominal rent for so long only as that area has no greater annual value.

CLEARANCE RIGHTS are rights of the War Depart- -ment in time of War to demolish any building or obstruction on the area made subject to such rights without payment of Compensation to the owner of such building or obstruction, but such rights are only granted at a nominal rent on the understanding that in the event of the Colonial Government at any time wishing to sell any portion or portions of such area the War Department shall

(a) release the portion or portions to be sold from Clear-

-ance Rights or

(b) pay to the Colonial Government the difference between

the price the land would fetch free of such rights and that which it actually fetches when sold subject to those rights;

(c) purchase the land at the auction and so pay the full

market price for it.

I have given Colonel Lewis' views of the nature

of the interest of the War Department in lands in this Colony. I have given a specimen of an Agreement relating the property coming under Colonel Lewis' *Second Category" I have indicated some of the dis- -advantages existing at present and I have suggested a remedy. I feel that there may be other objections to the present state of things which have not occurred to me and possibly better remedies than I nave suggested, but this letter is only intended to raise the question of whether a closer definition of the nature of the interests within
